1. SCOPE

These general terms and conditions govern the legal relationship between theatre visitors and the Deutsche Oper am Rhein (DOR) for DOR performances at Opernhaus Düsseldorf / Theater Duisburg. Purchasing an entry ticket, a voucher, other DOR products or agreeing a subscription contract includes the acceptance of these terms and conditions.

These general terms and conditions apply to members of organized visitor groups as long as nothing has been agreed to the contrary. These general terms and conditions apply to subscribers in the absence of any special rules in the terms and conditions for subscriptions to the DOR.

2. ENTRY TO PERFORMANCES

A valid entry ticket and in the case of reduced price tickets supporting I.D. must be shown to front of house staff. Each entry ticket entitles 1 person to visit the performance. Visitors who are late have no entitlement to enter the performance. As long as this is possible without disturbing the performance, they may be allowed to enter the auditorium upon the instructions of the front of house staff. Visitors who are late have the opportunity to follow the performance on a monitor in the foyer.

3. PROGRAMME / TIMES OF PERFORMANCES

The programme with times of performances and cast lists will be published regularly by the DOR. The details which are given in the programme, on posters and in other publications cannot be guaranteed. Changes may be made.

4. TICKET SALES

Tickets may be obtained from the DOR’s daytime and evening box offices and from DOR advance sales points. The evening box office usually opens one hour before the performance begins, including for morning and afternoon performances.

 You can purchase tickets at any time through the websites www.operamrhein.de andwww.ballettamrhein.devia the webshop (payment by credit card or direct debit) or use the order form to reserve tickets. Both options can be accessed by clicking on the € symbol next to the performance dates in the online programme.

5. ADVANCE SALES

Advance sales cover the entire season. Changes may be made.

Tickets ordered in advance are usually reserved for 10 days after the ticket request has been received. If tickets ordered in advance are not collected, the reservation will be cancelled. Changes may be made to the length of the reservation period. Reserving tickets to be held at the evening box office is only possible if the tickets have been paid for within the reservation period. Details of the procedure for advance sales and reservations in writing or by telephone are specified in the DOR‘s annual programme brochure and the monthly leaflets.

6. Entry Prices

Valid entry prices are usually fixed afresh for each season. They can be found in the DOR’s published programmes.

7. REDUCED ENTRY PRICES

The following reduction apply to performances by the DOR at Opernhaus Düsseldorf / Theater Duisburg:

Reductions of approx. 50% will be received by: School students, students and those in training under 28 years of age and volunteers (Bundesfreiwilligendienst / Freiwilliges Soziales Jahr); war wounded and the heavily injured or disabled with 70% disability or above plus companion, where this is recorded in the I.D.; recipients of Arbeitslosengeld and Arbeitslosengeld II and persons in receipt of basic support on grounds of age or reduced income or other recipients of social assistance (those in receipt of Sozialhilfe, in Duisburg holders of the Duisburg-Pass), receive a reduction of approx. 50% of the price of a single entry ticket. The reduction is available on presentation of the relevant I.D. (entitlement card) at both the advance sales office and evening box office. The holders of reduced price tickets are required to present appropriate proof of entitlement to the reduction to front of house staff at Opernhaus Düsseldorf / Theater Duisburg. No reductions are available for premieres or the performance on New Year’s Eve. For special performances reductions will be determined on a case by case basis.

Groups may receive the following reductions: for groups of 20 persons or more the price of tickets may usually be reduced by approx. 20%. For school classes there are usually special reductions available. These are published in the seasonal brochures released annually. Group reductions are not available for premieres in price categories 1 to 5 or for the performance on New Year's Eve in any price category. Reductions for other special events will be offered on a case by case basis. 

As the external costs included in the ticket price are not reduced, the price of reduced tickets will be slightly higher than the percentage reduction.

8. RETURN OF PURCHASED ENTRY TICKETS

Once sold, in principle entry tickets cannot be returned or exchanged. In the event of a return – in the form of a voucher for exchange – being permitted for reasons of goodwill, this will incur a service charge of up to 8.00 EUR. No replacement will be made for tickets which have expired. If another work is performed instead of the work announced at the time when the ticket was bought, purchased tickets may be returned to the box office at any time up until the start of the performance. Changes of cast and other changes to the running of the performance at short notice do not as a rule justify the return of entry tickets. If the performance cannot be completed the DOR will make its best endeavours to offer a replacement performance. If this is not possible, the entry price will usually be refunded. The decision to do so rests in each individual case with the theatre management. In the event of a performance failing to take place due to force majeure or a being missed by a visitor no replacement will be made. No claims against the DOR for reimbursement other than those listed above will be admitted. In particular any additional expenses visitors have incurred (travel costs etc.) will not be reimbursed. All claims for reimbursement of the price of entry must be submitted to the DOR in writing within two weeks. After that, any claim lapses.

9. LOSS OF ENTRY TICKETS

If an entry ticket is lost, no claim exists in principle against the DOR to provide a replacement ticket.

10. NOTICE OF CANCELLATION

a. Right of cancellation

As a matter of principle ticket purchases cannot be cancelled, §312 par.2 No.9 German Civil Code.

You have the right to cancel purchases made by telephone or through our webshop using vouchers or other goods within 14 days without having to provide a reason. The notice period begins 14 days from the date on which you or a third party named by you which is not an agency takes possession of the goods. In order to exercise your right of cancellation, you have to inform us, OPERNSHOP DÜSSELDORF, Heinrich-Heine-Allee 24, 40213 Düsseldorf, ticket@operamrhein.deor THEATERKASSE DUISBURG, Opernplatz, 47051 Duisburg, theaterkasse@operamrhein.de, by means of an explicit declaration (e.g. a letter submitted by post or e-mail) of your decision to cancel this contract. To do this you may use the attached specimen cancellation form, however, this is not compulsory. To observe the notice period, it is sufficient for you to have dispatched your notification of exercising your right of cancellation before the notice period has elapsed.

b. Following cancellation

Once you have cancelled the contract, we are obliged to repay all payments we have received from you including any delivery charges incurred (with the exception of additional costs which have arisen because you chose a form of delivery other than the economical standard delivery option we offer) directly and within 14 days of us receiving notification from you of this contract being cancelled. For this repayment we will use the same means of payment which you used for the original transaction unless we have explicitly agreed an alternative with you. In no event will you be charged a fee for this repayment.

You are obliged to return the goods to us directly within 14 days of the date on which you notified us of the cancellation of this contract, either by post or in person. The notice period has been observed if you have dispatched the goods before the 14 day notice period has elapsed.

You must bear the costs of returning the goods.

You will be obliged to pay for loss of value of the goods only if a check on the condition, quality and functionality of the goods indicates that this loss of value is due to improper use by you.

c. Exemption from cancellation

The user’s right to cancel a contract for provision of a service in connection with leisure activities does not apply when the contract refers to a specific date or period of time, §312 g Para. 2 No.9 German Civil Code. This means that for all dated tickets for the Deutschen Oper am Rhein, Theatergemeinschaft Düsseldorf Duisburg, no right of cancellation exists. Each ticket purchase is therefore binding immediately upon payment or confirmation of the purchase through the webshop and the customer is obliged to accept and pay for the tickets.

Furthermore there is no right to cancel a contract to deliver sound or video recordings in sealed packages once these seals have been removed.

11. CLOAKROOM

Overcoats, umbrellas, large bags and similarly bulky objects make not be taken into the auditorium.

These objects can be left in the relevant cloakrooms. In exchange the visitor will be handed a cloakroom token. No responsibility is taken for safeguarding cash, valuables, jewellery etc. On presentation of the cloakroom token, DOR staff is entitled to hand objects left in the cloakroom over to the token holder without any further check on ownership. If the cloakroom token is lost, objects deposited may only be handed over once the visitor has been able to prove or establish a credible case for their ownership. In order to replace the cloakroom ticket, 10.00 EUR must be paid to the DOR. DOR is responsible for loss or damage to any objects deposited in the cloakroom only in cases when the cloakroom staff has been negligent in its duties either deliberately or through gross incompetence. Claims for loss or damage to objects deposited in the cloakroom are limited to a sum of 2,500.00 EUR. Claims to replace objects lost from overcoats, handbags and other receptacles are limited to a maximum of 100.00 EUR. Damage to or loss of objects deposited must be brought to the attention of cloakroom staff without delay. In order to be valid, claims for damage to or loss of deposited objects must be made in writing within one month of the performance visited at the Deutsche Oper am Rhein. After this point in time it will no longer be possible to make any of the above claims.

12. HOUSE RULES

The entry ticket is valid for the seat indicated. A change of seat is possible in individual cases with the permission of the front of house staff. Visitors in possession of watches with acoustic time signals or mobile telephones are required to turn these devices off on entering the auditorium in order to avoid disturbing other members of the audience. Visitors who interfere with the running of a performance or disturb other members of the audience, may be ejected from the auditorium and in the event that further disturbances are to be expected of them, excluded from subsequent performances. Absolutely no smoking is permitted in Opernhaus Düsseldorf / Theater Duisburg. In fires and other emergencies, visitors are to leave the building immediately without any detour by the exit or emergency exit indicated. They must obey the instructions of the front of house staff.

13. BAN ON VISUAL AND/OR SOUND RECORDINGS

Recordings of images (film or video) and/or sound during the performance, including for personal use, are forbidden for copyright reasons. Unauthorized recording is liable for damages (§ 97 Law of Copyright). In cases of infringements the front of house staff are entitled to confiscate recording devices including cameras and hold them until the end of the performance. Recording materials of any kind on which parts of the performance have been recorded will be confiscated and retained by Deutsche Oper am Rhein. They will be returned to the owner once s/he has consented to the prior deletion of the recording.

14. LIABILITY

Liability for damages of any kind sustained by a visitor on the premises of the DOR is restricted to damages caused by the deliberate or grossly negligent fault of employees of or those acting for or on behalf of DOR.

15. DATA STORAGE NOTICE

The data you provide is used solely for the purpose of our contractual relationship, for purposes of marketing our own products and for sending informative material (§ 28 paragraph 1 page 1 No. 1 and § 28 paragraph 3 Federal Data Protection Act) and will only be passed to the contracted partner of the Deutscher Oper am Rhein with responsibility for ticketing(CTS Eventim Solutions GmbH, Contrescarpe 75A, 28195 Bremen) for the above mentioned purposes. You have the right to forbid the storage of your data at any time (as far as this is possible under applicable law). The responsible party under The Federal Data Protection Act is the Deutsche Oper am Rhein, Heinrich-Heine-Allee 16a, 40213 Düsseldorf.

16. APPLICATION

These general terms and conditions become effective on the day they are signed.

17. AMENDMENTS AND SUPPLEMENTS

If individual clauses are or become inapplicable, both contractual partners are obliged in consideration of the purpose of this contract to replace these with valid rules of the closest possible equivalent economic value. The validity of the remainder of the contract remains unaffected.
